By using AggiuBonu Data Recovery services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legal agreement between you and AggiuBonu Data Recovery Inc., a corporation registered in Ontario, Canada.

2. Service Description

AggiuBonu Data Recovery provides professional data recovery services including:

  • Hard disk drive (HDD) data recovery
  • Solid-state drive (SSD) data recovery
  • RAID array reconstruction and recovery
  • Mobile device data recovery
  • Emergency and expedited recovery services

We strive to recover your data using industry-standard techniques and equipment, but cannot guarantee successful recovery in all cases.

3. No Data, No Fee Policy

Our "No Data, No Fee" policy means:

  • You pay only if we successfully recover your data
  • Evaluation and diagnosis are provided free of charge
  • Shipping costs are the responsibility of the customer
  • Emergency and expedited services may have different fee structures
  • Parts replacement costs may apply in certain cases

4. Customer Responsibilities

Before Shipping

  • Stop using the affected device immediately to prevent further damage
  • Package the device securely using appropriate materials
  • Provide accurate contact information and device details
  • Declare any password protection or encryption

Legal Ownership

  • You must be the legal owner of the device or have authorization from the owner
  • You warrant that the data does not violate any laws or third-party rights
  • We reserve the right to refuse service for suspected illegal content

5. Service Process and Timeline

Evaluation

  • Free evaluation within 24-48 hours of receipt
  • Detailed quote provided before beginning recovery
  • Customer approval required to proceed

Recovery Timeline

  • Standard recovery: 3-7 business days
  • Complex cases: 1-2 weeks
  • Emergency service: 24-48 hours (additional fees apply)
  • Timelines are estimates and may vary based on case complexity

6. Limitation of Liability

Our liability is limited as follows:

  • Total liability shall not exceed the value of the service fee
  • We are not liable for the original data loss or its consequences
  • We are not responsible for any business interruption or lost profits
  • Our warranty covers only the recovery service provided
  • Some jurisdictions do not allow limitation of liability; in such cases, liability is limited to the maximum extent permitted by law

7. Data Confidentiality and Security

  • All customer data is treated as strictly confidential
  • ISO 27001 certified security protocols are followed
  • Data is securely destroyed after delivery unless otherwise requested
  • Employee access is limited to necessary personnel only
  • Facilities are monitored and access-controlled

8. Payment Terms

Accepted Payment Methods

  • Credit cards (Visa, MasterCard, American Express)
  • Bank transfers and wire transfers
  • Corporate purchase orders (approved accounts)
  • Cash (for in-person delivery only)

Payment Schedule

  • Payment due upon successful data recovery
  • Payment required before data delivery
  • Emergency services may require advance payment
  • Corporate accounts may arrange net-30 payment terms

9. Device Handling and Return

  • Devices are handled with professional care using industry standards
  • Original devices are returned unless disposal is requested
  • Shipping insurance is recommended for valuable devices
  • Unclaimed devices after 90 days may be disposed of securely
  • Storage fees may apply for extended device retention

10. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including:

  • Natural disasters, acts of God
  • Government actions, laws, or regulations
  • Labor strikes or disputes
  • Supplier failures or shortages
  • Pandemic-related restrictions

11. Intellectual Property

  • Customer retains all rights to their data and intellectual property
  • AggiuBonu retains rights to recovery techniques and methodologies
  • Website content, logos, and trademarks are owned by AggiuBonu
  • No license is granted to use our proprietary methods or technologies

12. Governing Law and Jurisdiction

These terms are governed by the laws of Ontario, Canada and federal Canadian law. Any disputes shall be resolved in the courts of Ontario, Canada.

If any provision of these terms is found invalid, the remaining provisions shall continue in full force and effect.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Continued use of our services constitutes acceptance of modified terms.

For significant changes, we will provide reasonable notice to existing customers.

14. Termination

Either party may terminate the service agreement:

  • Customer may cancel before work begins without penalty
  • We may refuse service for legal or technical reasons
  • Termination does not affect payment obligations for completed work
  • Customer data will be securely destroyed upon termination
